First Session of Expert Mechanism on the Rights of Indigenous Peoples

First Session of Expert Mechanism on the Rights of Indigenous Peoples took place in the Office of the High Commissioner for Human Rights (Geneva) on 1 – 3 October 2008. Gulvayra Shermatova - president of LIENIP, Elena Nechushkina - director of Krasnoyarsk Center, Irina Solodukha – director of Altai Republic Center, and Lev Nerbyshev – director of Khakass Center represented LIENIP.
Expert Mechanism on the Rights of Indigenous Peoples elaborated its methods, though it did not adopt any resolution or make any decision. In line of agenda the right of indigenous peoples to education was discussed.
Annual sessions of Expert Mechanism should be open and this year 39 representatives of states (including Russian Federation), more than 80 representatives of public and non-governmental associations of indigenous peoples, representatives of the UN bodies, scientists and indigenous experts participated in the session as observers.
About Expert Mechanism in brief:
General Assembly adopted Resolution 60/251 and established Human Rights Council to carry out, analyze, improve, and rationalize when necessary all mandates, procedures, functions, and obligations of Commission on Human Rights to maintain formality system, expert counseling, and appeal procedure (article 6).
Human Rights Council in its resolution 6/16 asked Office of the High Commissioner for Human Rights to convene Caucus to exchange opinion on the most suitable mechanisms of continuation of work of now abrogated Working Group on Indigenous Populations activities. The Caucus took place in Geneva on 6 – 7 December 2007.
Human Rights Council complying with its resolutions 5/1 and 6/16 and General Assembly's resolution 60/251 resolved to establish Expert Mechanism on the Rights of Indigenous Peoples as a subsidiary body of the Council in resolution 6/36. Human Rights Council noted in its resolution 6/36 that General Assembly adopted Declaration on Right of Indigenous Peoples in resolution 61/295 during its 61st session. The Declaration is the main instrument to protect rights of indigenous peoples and amends International Labour Organization Convention (No. 169) concerning Indigenous and Tribal Peoples in Independent Countries. The Declaration serves as a normative base for Expert Mechanism mandate.
